The terms and conditions set out in the Privacy Policy apply to natural persons when visiting our website www.alwark.lt , visiting our online store https://eshop.alwark.lt and submitting requests for equipment, communicating with our company and otherwise submitting personal data in the situations listed below. Please re-read the relevant version of this document regularly, as its contents may change in the future. The terms used in the Privacy policy shall be understood as they are defined in the Regulation.

The information below includes the following purposes of data processing: (i) recruitment and administration of the database of candidates for employment; (ii) communication by e-mail and other electronic means; (iii) processing requests at the online-store and their implementation including order processing, financial document issue and resolving issues related to the warranty of goods, their delivery and/or return; (iv) use of cookies; (v) use of social networks; (vi) execution of the loyalty program, the sending of newsletters and implementation of other direct marketing; (vii) the administration of complaints, inquiries or orders. This Privacy policy also describes your rights as a data subject, the provision of data to their recipients and other terms of processing of personal data that apply to all personal data processed by the company for the purposes listed above.

Employee selection

If, in order for your data to be included in our candidate database, you have sent your CV to the Company or sent your CV according to an advertisement on our website or on a specialized website for recruitment and job search, the personal data you voluntarily submitted and other personal data described below will be processed by us for the purposes of employment candidate selection.

We will process your personal data for the participation in the selection, until the end of the selection process, i.e. until the time we decide to recruit a specific candidate, his probationary period expires or we decide to complete the selection without any candidate being selected. This period lasts about 4 months. If you do not object, we will store your data for 3 years after the completion of the selection, and if there is a need for a new employee in our company during this period, we will contact you. After the expiration of 3 years, we will destroy your personal data. If you object to the storage of your data after the selection has been completed, please inform us thereof by e-mail or by means of an information form that we will send you to sign during the meeting.

If you sent your CV and other data in the absence of a published selection, we will store your data for 3 years without asking for a separate consent, on the basis of your will to provide the data.

We will process your personal data on the basis of your expressed will to participate in the selection or store the data in the database, and after the completion of the selection, on the basis of a legitimate interest. Submitting data is voluntary, but without data we would not be able to assess the appropriateness of your candidacy. You can cancel participation in the selection or storage of data in the candidates’ database at any time.

Please be informed that by exercising the right granted to us by personal data protection legislation, we may contact your previous employers and ask them for an opinion on your qualifications, professional skills and subject characteristics. However, we will not contact your current employer without your explicit prior consent.

Communication by e-mail and other electronic means

The basis for processing your personal data provided in electronic communication is your expression of free will to carry out this communication and provide certain data in it, i.e. consent. Furthermore, the basis for data processing is also the conclusion or performance of a contract and the fulfilment of statutory obligations. In addition to the conclusion and performance of the contract, your data is also processed for internal administration and consultation purposes.

Your email address, correspondence content and related data will be processed in accordance with the principle of proportionality. This data is primarily visible to the person with whom you communicate directly by e-mail or other electronic means. However, in certain cases, your correspondence may also be read by other employees, for example, electronic monitoring of the workplace, investigation of possible violations of legislation or internal rules, replacement of the employee and related purposes, and similar situations. In order to ensure the provision of remote services and the quality of service, we will keep your provided data and correspondence for 1 month from the day they were submitted.

Requests regarding equipment in the online store

If you provide your personal data in order to submit a request for equipment, i.e. your  name, surname, e-mail address, telephone number, delivery address, and if you are acting on behalf of a legal entity – name, surname, e-mail address, telephone number, delivery address, company name, company code, VAT payer’s code and bank account number, your voluntarily submitted data will be processed on the basis of concluding and executing a contract (including certain actions before concluding the contract), as the Company manages the Buyer’s personal data of representatives and / or other persons authorized to communicate with the Company and / or collect the goods ordered by you. Once the contract has been concluded, the processing will also be based on the fulfillment of legal obligations, such as those arising from tax obligations. We will process your data for internal administration and consulting purposes. You provide the above-mentioned personal data to the Data Controller voluntarily by filling in the request in the online store. Our company must process this data in order to enable you to make requests about the equipment in the online store and to properly fulfill the legal obligations arising from the contract. If you do not provide personal information in the online store, you will not be able to submit a request, and our company will not be able to administer and contact you for the desired equipment and provide accurate information about the requested item, including price and delivery costs. Your personal data will be stored for 2 (two) months from the date of the submission of request.

In order to ensure proper administration and execution of the request, we will process the data you voluntarily provide – the date and time of placing the order, IP address, product name, quantities, product prices and discounts and bank account number. The basis for the processing of this data is the performance of the contract and the performance of legal obligations. When administering the request, we will contact you according to the contacts indicated in the request so that we can discuss your expectations regarding the equipment and, if a purchase and sale agreement will be signed, agree on the terms of the contract. After the execution of the request and signing the purchase and sale contract the data will be processed for 10 (ten) years from the date of the purchase transaction.

Before submitting a request regarding equipment, please confirm that the personal data you provide is accurate and correct and that you are at least 18 (eighteen) years of age.

We accept no liability for inaccurate, incomplete or incorrectly submitted data. Upon your request for equipment, we will consider your data to be accurate and correct, and your consents are given at your own discretion by reading this Privacy Policy.

If you have decided to withdraw from the concluded contract and / or wish to return the unsuitable product (s) delivered to you and request a refund, in order to ensure the proper goods and paid money return process and could implement our determined legal obligations we may ask you to provide: name, surname, signature, telephone number, address or delivery address, e-mail address, and bank account number, date of application, reason for return of goods, information of the represented legal entity listed above in this Policy, if acting on behalf of the legal entity, a request for withdrawal from a contract and (or) a request for the return of the goods or a deed of transfer of the goods, or a request for a refund (when the goods have not been handed over to you). The data will be processed for 10 (ten) years from its submission.
